Terms of Service

1. Acceptance of Terms

By accessing or using WhoseWeek (the “Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service. We may update these Terms at any time; continued use after changes are posted constitutes acceptance of the revised Terms, and for material changes we'll notify you in-app or by email.

2. Description of Service

WhoseWeek is a scheduling and coordination platform for co-owners and co-users of shared vacation properties. Features include shared calendars, week trading, annual assignments (live draft, random, weighted, repeat, shift, CSV import), a slot manager, circles, message boards with private threads, photo galleries, maintenance and expense tracking, polls, guestbooks, local guides, notifications, and calendar export/sharing. The Service is provided “as is” and we reserve the right to modify, add, remove, suspend, or discontinue any aspect of it at any time, with or without notice.

3. Eligibility

You must be at least 13 years old to use the Service. If you use WhoseWeek on behalf of an organization, household, or group, you represent that you have authority to bind that entity to these Terms. WhoseWeek is currently offered in early access; access may be invite-only or subject to approval.

4. User Accounts

You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account.
  • Notifying us immediately of any unauthorized access or use of your account.
  • Ensuring that the information you provide is accurate and kept up to date.

We may suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, pose a risk to the Service or other users.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Post or transmit content that is defamatory, obscene, harassing, threatening, hateful, or otherwise objectionable.
  • Upload content that infringes the intellectual-property, privacy, or publicity rights of others (including photos of people who have not consented to being shared within your group).
  • Upload viruses, malware, or any code or file intended to disrupt or damage the Service or its users.
  • Attempt to gain unauthorized access to any part of the Service, other users' accounts, or its underlying systems.
  • Interfere with, disrupt, probe, or stress-test the Service.
  • Use automated means (scrapers, bots, harvesters) to access or extract data from the Service without our express written permission.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Use the Service to send unsolicited bulk communications or for any commercial resale of vacation-home scheduling services.

6. User Content and License

You retain ownership of the text, photos, calendar entries, and other content you submit (“User Content”). By submitting User Content, you grant WhoseWeek a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your User Content solely as necessary to operate, provide, and improve the Service — for example, by serving your photos to other members, delivering your messages by email, or producing iCal feeds of your stays. You also grant each other member of the property or circle you share content with the rights necessary to view that content within the Service.

You represent and warrant that you have all rights necessary to submit your User Content and grant these licenses, and that your User Content does not violate any law or infringe the rights of any third party. You are solely responsible for your User Content.

7. Property Roles and Admin Actions

Each property has at least one owner and may have additional admins. Admins can manage the calendar, run annual assignments, approve or reverse trades (where admin approval is required), moderate threads (including private threads), edit property settings, and add or remove members. Admin actions affect everyone on the property and can change or remove your stays, messages, photos, or other content. You acknowledge that by joining a property you consent to the property's admins exercising these powers. Disputes over admin decisions are resolved between members; see Section 12.

8. Third-Party Services

The Service relies on third parties for hosting, email delivery, weather data, and map tiles (see our Privacy Policyfor the list). We are not responsible for the availability, accuracy, or content of third-party services. Your use of any third-party feature may also be governed by that provider's terms.

9. Fees

WhoseWeek is currently provided at no charge during early access. We may introduce paid features or plans in the future; if we do, we'll give you clear notice and the opportunity to accept or decline before any charge applies.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT CALENDAR DATA, NOTIFICATIONS, OR EMAILS WILL BE DELIVERED OR DISPLAYED WITHOUT DELAY OR ERROR. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WHOSEWEEK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, GOODWILL, PROPERTY-USE VALUE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

12. Property Scheduling Disclaimer

WhoseWeek is a coordination tool only. It does not own, manage, inspect, insure, clean, or operate any property, and it is not a party to any ownership agreement, rental arrangement, trade, or scheduling decision between users. Any calendar assignments, trades, pre-assignments, draft outcomes, ownership percentages, or shared-expense splits recorded in the Service reflect what users have entered, not any independent verification. We do not guarantee availability of a property at any scheduled time. All disputes between co-owners or users regarding property access, scheduling conflicts, trades, expenses, or any other matter are solely the responsibility of those users.

13. Indemnification

You agree to indemnify, defend, and hold harmless WhoseWeek and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

14. Termination and Account Deletion

You may stop using the Service or request deletion of your account at any time (see our Privacy Policyfor how deletion is handled). We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. Upon termination, your right to use the Service immediately ceases. Provisions of these Terms that by their nature should survive termination — including User Content license (Section 6), disclaimers (Section 10), limitation of liability (Section 11), indemnification (Section 13), and governing law (Section 15) — shall survive.

15. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or your use of the Service will be resolved exclusively in the state or federal courts located in North Carolina, and you consent to their personal jurisdiction.
